Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you”, “Customer”) and Velthar Services Private Limited (“Factro”, “we”, “us”), the operator of the Factro platform at factro.in and app.factro.in (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

Factro is a software-as-a-service platform for Indian manufacturers offering production monitoring, predictive maintenance alerts, invoicing, CRM and related operational tools. We may add, change or remove features from time to time.

2. Eligibility & accounts

You must be at least 18 years old and authorised to act for your business to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately of any unauthorised use.

3. Plans, billing & taxes

• Paid plans are billed in advance on a monthly or annual cycle through our payment processor, Razorpay. We do not store your full card or bank details.
• All prices are in Indian Rupees (₹). GST is charged in addition, as applicable, and shown at checkout.
• Subscriptions renew automatically at the end of each cycle until cancelled. You can cancel at any time — see our Refund & Cancellation Policy.
• Paid plans may include a free trial; if you do not subscribe by the end of the trial you are moved to the Free plan.

4. Acceptable use

You agree not to misuse the Service. In particular, you will not:

• break any applicable law, or infringe anyone’s rights;
• attempt to gain unauthorised access to the Service, other tenants’ data, or our systems;
• reverse engineer, resell or overload the Service; or
• upload unlawful, harmful or malicious content.

5. Your data

You own the data you put into Factro (“Customer Data”). You grant us a limited licence to host and process it solely to provide and improve the Service, as described in our Privacy Policy. We apply tenant isolation so your data is not visible to other customers.

6. Intellectual property

The Service, including its software, design and content (excluding Customer Data), is owned by Factro and protected by law. These Terms do not transfer any of our intellectual property to you.

7. Third-party services

Factro relies on third-party providers (for example Razorpay for payments, and cloud hosting, messaging and AI providers) to deliver the Service. Your use of those features may also be subject to the relevant provider’s terms.

8. Availability & warranties

We work hard to keep Factro available and reliable, but the Service is provided “as is” without warranties of any kind, including uninterrupted or error-free operation, to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Factro’s total liability arising out of or relating to the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim. We are not liable for indirect or consequential losses.

10. Suspension & termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or fail to pay. On termination you may export your Customer Data for a reasonable period, after which it may be deleted.

11. Governing law

These Terms are governed by the laws of India. The courts at Kallakurichi, Tamil Nadu shall have exclusive jurisdiction, subject to applicable law.

12. Changes

We may update these Terms from time to time. Material changes will be notified in the app or by email, and the “Last updated” date above will change. Continued use after changes take effect means you accept the updated Terms.
